1. Website Owner, Our Offering & Binding Agreement
This website is owned and operated by [BPE Legal/DBA Name], a DBA of Feather and Scale Design, LLC ("BPE," "we," "us," or "our"). These Terms and Conditions ("Terms") set forth the terms and conditions under which you may use our website and the services we offer. This website offers visitors information about, and scheduling of, fire extinguisher inspection, recharge, testing, installation, and disposal services for residential, commercial, and new construction properties throughout San Marcos and the surrounding Texas Hill Country.
By accessing or using this website, you confirm that you have read, understood, and agree to be bound by these Terms.
2. Who Can Use This Website
In order to use our website and/or request our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right, and freedom to enter into these Terms as a binding agreement. You may not use this website or our services if doing so would be prohibited under any law or regulation applicable to you.
3. Scheduling & Service Terms
When you request or schedule a service through this website, you agree that:
- You are responsible for providing accurate property, contact, and site-access information at the time of booking.
- Service pricing is confirmed at the time of scheduling and may vary based on property size, unit count, and service type.
- A completed booking constitutes a request for service, not a guaranteed time slot until confirmed by us.
- Rescheduling or cancellation requests should be made with reasonable advance notice; late cancellations or missed appointments may be subject to a rescheduling fee.
We reserve the right to change our pricing at any time and to correct pricing errors that may occur on the website. Any applicable taxes or fees will be disclosed prior to service completion.
4. Right to Change Our Offering
We may, without prior notice, change the services we offer, stop providing any service or feature, or place limits on our services. We may permanently or temporarily suspend access to any part of the website for any reason, or for no reason, without liability.
5. Educational Content and Proper Use Disclaimer
The website may contain general information regarding fire extinguisher use, maintenance, inspection schedules, and related fire safety topics. This content is provided for general informational purposes only and does not constitute professional fire safety training, certification, or guidance specific to your property or situation.
**BPE is not responsible or liable for any losses, damages, injuries, or claims arising from a user's lack of education, training, or improper use of fire extinguishers or related equipment.** Proper fire extinguisher use requires hands-on training. Users should not rely solely on website content as a substitute for professional instruction, applicable fire code requirements, or guidance from qualified fire safety personnel.
6. Warranties & Responsibility for Services
Where we perform inspection, recharge, testing, installation, or disposal services, we warrant that such services will be performed in accordance with applicable NFPA 10 standards and state fire code requirements in effect at the time of service. If a service is found to be deficient due to our error, we will re-perform the applicable service at no additional charge, or issue a partial or full refund for the deficient service, at our discretion.
This warranty does not cover damage, malfunction, or non-compliance resulting from misuse, tampering, third-party servicing, or failure to schedule required follow-up inspections.
7. Ownership of Intellectual Property
The website and all materials on it — including text, graphics, logos, images, and software — together with all related intellectual property rights, are the exclusive property of BPE. Except as explicitly provided in these Terms, nothing here creates a license in or under any such intellectual property rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works from any website content without our prior written permission.
8. Right to Suspend or Refuse Service
We may refuse, suspend, or cancel service requests at our sole discretion, including where we determine that a request violates these Terms, poses a safety risk, or falls outside applicable code or regulatory requirements. You may cancel a scheduled service or discontinue use of the website at any time, subject to Section 3.
9. Indemnification
You agree to indemnify and hold harmless BPE and its owners, employees, and agents from any demands, losses, liabilities, claims, or expenses (including reasonable attorneys' fees) made against them by any third party arising out of or in connection with your use of the website, your violation of these Terms, or your improper use of fire extinguisher equipment.
10. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall BPE be liable for any indirect, incidental, special, consequential, or punitive damages — including, without limitation, damages for loss of profits, goodwill, use, data, or other intangible losses — arising out of or relating to your use of, or inability to use, this website or our services.
To the maximum extent permitted by applicable law, BPE assumes no liability or responsibility for: (i) errors, mistakes, or inaccuracies in website content; (ii) personal injury or property damage of any nature resulting from your access to or use of the website; (iii) any unauthorized access to or use of our servers or any personal information stored therein; or (iv) losses arising from a lack of education or improper use of fire extinguisher equipment, as described in Section 5.
In no event shall BPE's total liability for any claim exceed the amount you paid for the specific service giving rise to the claim.
11. Right to Change These Terms
We reserve the right to modify these Terms at any time, at our sole discretion. We recommend reviewing this page periodically. If we make a material change, we will take reasonable steps to notify users. Your continued use of the website after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the current or any future version of these Terms, please discontinue use of the website.

13. Governing Law & Dispute Resolution
These Terms, and any claims or disputes related to them or to our services, shall be governed by and construed in accordance with the internal substantive laws of the State of Texas, without regard to its conflict of law principles. Any such claims or disputes shall be brought exclusively in a court of competent jurisdiction located in Hays County, Texas.
